Alternate Dispute Resolution Attorney in Manchester

New Hampshire Arbitration & Mediation Process

Alternate Dispute Resolution (referred to as “ADR”) is a term generally recognizing the efficiency and cost-effectiveness of settling disputes between parties in a manner which avoids trial or hearing in a judicial or administrative process. ADR takes the form of arbitration (binding and non-binding), neutral evaluation and mediation.

Rule 170 of our Superior Court Rules requires every lawsuit filed in the State of New Hampshire to be the subject of ADR in some form in advance of trial. The success rate of the Superior Court ADR program exceeds 50% of cases settled in advance of trial. Independent of Rule 170, we often encourage clients to pursue ADR as an alternative to trial. In many cases, we and opposing counsel may agree on a third-party mediator to act in an ADR process.

The team of alternative dispute resolution lawyers at Brennan Lenehan Iacopino & Hickey are proud to offer valuable legal counsel that is backed by more than four decades of experience. Our goal is to resolve matters in a time-efficient, yet effective manner that keeps your interests at the forefront. ADR is an exceptional way to accomplish that.

Find out if ADR is right for you by contacting us at (603) 734-5461 today.

Benefits of Alternate Dispute Resolution

In the interests of our clients, we feel that, given two competent alternative dispute resolution attorneys representing opposing parties and given sound judgment on the prospect of a trial result, there is no substitute to mediation in reaching an agreement of any contested matter.

In many cases, alternative dispute resolution benefits the client in the following ways:

  • Tremendous cost savings
  • Results far in advance of trial

Who Pays for and Chooses a Mediator?

Traditionally, the parties in alternative dispute resolution may share the cost of the mediator. The mediator’s selection is made on the basis of agreement between the parties.
