Rule 170 of our Superior Court Rules requires every lawsuit filed in the State of New Hampshire to be the subject of ADR in some form in advance of trial. The success rate of the Superior Court ADR program exceeds 50% of cases settled in advance of trial. Independent of Rule 170, we often encourage clients to pursue ADR as an alternative to trial. In many cases, we and opposing counsel may agree on a third-party mediator to act in an ADR process.
